Last Updated: October 19, 2026

Welcome to Deliver This That and the other (“Company,” “we,” “us,” or “our”). We provide courier, delivery, personal concierge, and related services in Colorado.

These Terms & Conditions govern your access to our website and your use of our services. By using our website, requesting a quote, booking a service, or accepting a service quote, you agree to these Terms & Conditions. If you do not agree, please do not use our website or services.

1. Services

Deliver This That and the other provides courier and delivery services, personal concierge services, errands, and other services as agreed upon with individual customers.

Services may include, but are not limited to:

  • Pickup and delivery of approved packages, documents, and personal items.

  • Scheduled and same-day courier services, subject to availability.

  • Personal shopping, errands, and concierge requests.

  • Other customized services agreed upon in writing.

All services are subject to availability, geographic limitations, applicable laws, and our acceptance of the requested assignment. We reserve the right to decline or discontinue any request that we cannot safely, legally, or reasonably fulfill.

2. Quotes, Estimates, and Booking

Many of our services are customized to meet individual customer needs. Customers may be required to submit an inquiry before a quote or booking can be provided.

Any quote or estimate will be based on the information supplied by the customer, including the requested service, pickup and delivery locations, timing, distance, item characteristics, access requirements, and any special instructions.

Unless otherwise stated in writing:

  • Quotes are valid for the period specified in the quote.

  • A quote is not a confirmed booking until accepted by both parties.

  • Additional charges may apply if the requested service changes or the information provided is inaccurate or incomplete.

  • We may revise a quote before acceptance if material details change.

A booking is confirmed only after we provide written confirmation and any required deposit, payment, or other booking requirements have been satisfied.

3. Pricing and Payment

Service fees will be communicated through a quote, invoice, written agreement, or other approved communication before the service is performed.

Depending on the assignment, charges may include service fees, mileage, waiting time, additional stops, after-hours service, special handling, parking, tolls, shopping costs, or other expenses disclosed to the customer.

Payment terms will be specified in the applicable quote or invoice. We may require payment in advance, a deposit, or payment upon completion.

Customers are responsible for paying all undisputed amounts by the stated due date. Late payments may result in paused or declined future services and, where permitted by law and disclosed in advance, applicable late fees or collection costs.

Payments are processed through the payment method or provider identified on the invoice. We do not intend to collect full payment-card details through ordinary website inquiry forms.

4. Cancellations, Rescheduling, and Refunds

Customers should contact us as soon as possible to cancel or reschedule a confirmed service.

Any cancellation deadlines, nonrefundable deposits, rescheduling fees, or other cancellation terms will be stated in the applicable quote, invoice, or written service agreement before the booking is confirmed.

If a customer cancels after we have begun performing the service or incurred authorized expenses, the customer may be responsible for the work completed and expenses incurred, as permitted by law and the agreed terms.

If we must cancel or cannot complete a service, we will make reasonable efforts to notify the customer and discuss available alternatives. Refunds, if applicable, will depend on the work performed, expenses incurred, and the circumstances of the cancellation.

Nothing in this section limits any refund or other right that cannot legally be waived.

5. Customer Responsibilities

Customers agree to:

  • Provide accurate contact information, addresses, access instructions, and service details.

  • Ensure that pickup and delivery locations are accessible and that necessary permissions have been obtained.

  • Properly package and identify items requiring transport, unless packaging is expressly included in the service.

  • Disclose any special handling requirements, fragile contents, applicable restrictions, or relevant safety concerns.

  • Ensure that they have the legal right to request transportation or handling of the items.

  • Provide accurate delivery instructions and ensure that the recipient is available when required.

  • Pay agreed fees and authorized additional charges.

We are not responsible for delays or additional costs resulting from inaccurate instructions, inaccessible locations, unavailable recipients, improper packaging, or circumstances outside our reasonable control.

6. Delivery Procedures and Proof of Delivery

Delivery arrangements will be agreed upon in the booking or service instructions. Depending on the assignment, proof of delivery may include a delivery confirmation, recipient acknowledgment, photograph, electronic record, or other reasonable documentation.

Customers should tell us in advance if a signature, identification check, restricted handoff, or other special delivery procedure is required. We must expressly agree to special procedures before the service begins.

If no one is available to receive a delivery, or the delivery location cannot be accessed safely, we may contact the customer to arrange redelivery, an alternative location, or return of the item. Additional charges may apply if disclosed in the applicable quote or agreement.

We will use reasonable care when handling customer property but cannot guarantee that a recipient will be available or that a delivery will be completed at an exact time unless a specific guarantee is expressly agreed to in writing.

7. Prohibited and Restricted Items

Customers must not request transportation of items that are illegal, unsafe, improperly packaged, or prohibited by applicable law.

Unless we expressly agree in writing and are legally authorized and properly equipped to handle them, prohibited or restricted items include:

  • Illegal drugs, controlled substances, and unlawful goods.

  • Firearms, ammunition, explosives, and other dangerous weapons.

  • Hazardous, toxic, flammable, or explosive materials.

  • Live animals or human remains.

  • Perishable goods requiring temperature control or special handling that we have not agreed to provide.

  • Cash, negotiable instruments, jewelry, precious metals, or other high-value items requiring specialized security or insurance that we have not agreed to provide.

  • Prescription medications or regulated medical materials requiring special authorization or handling.

  • Any item whose transport would violate applicable law or the rights of another person.

Customers must disclose the nature of an item when reasonably necessary to determine whether it can be accepted. We may refuse, suspend, or terminate a service involving a prohibited, undisclosed, or unsafe item.

Customers are responsible for losses, claims, fines, or expenses arising from their unlawful conduct, material misrepresentations, or failure to disclose relevant item information, to the extent permitted by law.

8. Delays and Circumstances Beyond Our Control

Delivery times are estimates unless a specific guaranteed time has been expressly agreed to in writing.

We are not responsible for delays caused by circumstances beyond our reasonable control, including severe weather, traffic, road closures, accidents, vehicle breakdowns, public emergencies, government restrictions, labor disruptions, inaccessible locations, or customer or recipient unavailability.

If a significant delay or disruption occurs, we will make reasonable efforts to communicate with the customer and determine an appropriate next step.

9. Loss, Damage, and Service Limitations

We will exercise reasonable care in performing our services. Customers should disclose the approximate value and any special handling needs of items when requesting a quote.

To the extent permitted by applicable law, we are not responsible for loss or damage caused by:

  • Improper or inadequate packaging.

  • Inherent defects, ordinary wear, or the nature of the item.

  • Inaccurate or incomplete information supplied by the customer.

  • Acts or omissions of the customer or recipient.

  • Events outside our reasonable control.

We do not provide insurance coverage for customer property unless coverage is expressly confirmed in writing. Customers are encouraged to maintain their own insurance for valuable or irreplaceable items.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for fraud, willful misconduct, or other liability that cannot legally be waived.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Deliver This That and the other will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use of our website or services, including lost profits or business interruption, except where such damages cannot legally be excluded.

To the extent permitted by law, our total liability arising from a particular service will not exceed the amount paid or payable to us for that specific service. This limitation does not apply to liability that cannot legally be limited.

Nothing in this section overrides any applicable law governing carriers, transportation services, consumer rights, or the handling of specific types of property.

11. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Deliver This That and the other and its owners, employees, and authorized contractors from third-party claims, losses, liabilities, and reasonable expenses arising directly from your unlawful use of our services, your material misrepresentations, or your violation of these Terms.

This provision does not require you to indemnify us for our own negligence, willful misconduct, or other conduct where indemnification is prohibited by law.

12. Website Use and Intellectual Property

All website content, including text, graphics, logos, photographs, design elements, and other materials, is owned by or licensed to Deliver This That and the other unless otherwise stated.

You may view and use our website for personal or legitimate business purposes. You may not reproduce, distribute, modify, publish, or commercially exploit our content without prior written permission, except as permitted by law.

You agree not to misuse our website, attempt unauthorized access, introduce malicious code, interfere with website functionality, or use the website for unlawful purposes.

13. Privacy

Our collection and use of personal information are described in our Privacy Policy, available at [link to Privacy Policy].

By using our website or requesting our services, you acknowledge that personal information may be processed as described in that policy and as permitted by applicable law.

14. Third-Party Services and Links

Our website may contain links to third-party websites or use third-party services for payment processing, scheduling, analytics, or communications.

We do not control third-party websites or services and are not responsible for their independent content, policies, or practices. Your use of those services may be subject to their own terms and privacy policies.

15. Suspension or Refusal of Service

We may refuse, suspend, or discontinue a service where reasonably necessary for safety, legal compliance, nonpayment, inaccurate information, abusive conduct, prohibited items, or other material concerns.

Where practicable, we will notify the customer and explain any available alternatives. Any outstanding payment obligations will be handled in accordance with the applicable quote, invoice, and law.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute will be handled in a court of competent jurisdiction as permitted by applicable law. Nothing in these Terms prevents either party from exercising a right that cannot legally be waived or restricted.

17. Changes to These Terms

We may update these Terms from time to time. The revised version will be posted on this page with an updated “Last Updated” date.

Changes will apply prospectively unless otherwise required by law. Material changes to an existing booking will be communicated to the customer when required.

18. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

The applicable quote, invoice, written service agreement, these Terms, and any expressly incorporated policies together govern the relevant service. If a signed written agreement conflicts with these Terms, the signed agreement will control to the extent of the conflict.
